This Do Not Call (DNC) Policy outlines our practices for outbound communications.

CRITICAL NOTICE: Submitting your phone number through our website constitutes TCPA-compliant express written consent for immediate contact by Accidental Justice and our network attorneys, regardless of National DNC Registry status.

1. Express Written Consent (TCPA Compliance)

When you voluntarily submit your telephone number through our case review form, you provide express written consent under 47 U.S.C. § 227 and 47 C.F.R. § 64.1200 for:

  • Manual dialing and automatic telephone dialing systems (ATDS)
  • Prerecorded or artificial voice messages
  • SMS/MMS text messages to any mobile number provided
  • Calls and texts regardless of National DNC Registry status
  • Contact 24/7 including evenings, weekends, and holidays

2. National Do Not Call Registry Compliance

Accidental Justice and our network attorneys maintain internal DNC lists AND comply with the National Do Not Call Registry (www.donotcall.gov). However:

  • Express written consent OVERRIDES National DNC status for submitted numbers
  • National DNC does NOT apply to business-to-consumer calls with prior consent
  • We scrub against National DNC for non-consensual marketing calls only

3. Opt-Out Procedures

You may revoke consent and opt-out of ALL future communications at any time using these methods:

4. Internal Do Not Call List

All opt-out requests are immediately added to our internal DNC database and shared with network attorneys:

  • Processing within 30 minutes of opt-out request
  • Suppression from ALL future autodialed calls/texts
  • Shared with all participating attorneys within 24 hours
  • Retained indefinitely unless you request reactivation

5. Network Attorney Responsibilities

Participating attorneys agree to:

  • Honor all opt-out requests received through any channel
  • Maintain their own internal DNC lists
  • Comply with TCPA, TSR, and state telemarketing laws
  • Cease all communications upon receiving "STOP" or equivalent

6. Time Restrictions

Unless you provide specific consent for 24/7 contact:

  • Phone calls: 8:00 AM - 9:00 PM local time (per TSR)
  • Texts: 8:00 AM - 9:00 PM local time
  • Emergencies: Case-sensitive exceptions may apply

7. Wireless Guidelines

We follow CTIA and carrier guidelines for mobile messaging:

  • Maximum 4 messages per 24-hour period
  • Maximum 1 message per hour
  • Standard message and data rates apply
  • Carrier messaging fees may apply
